Had auto accident on May 20th, 2008. My boss was driving and he was at fault unquestionably. After many tests and injections in my spine it has been decided I need surgery due to a pinched nerve which is causing me pain in my arm and back. Haven't slept more than 2 hours straight since the accident. Spinal injections were tried with no relief and i am now scheduled for Anterial Cervical Discectomy with Fusion on c5 and c7. They are estimating at least 3 months for a full recovery if the surgery is successful. The doctor is confident the surgery will definitely ease the pressure on the nerve. My question is once the doctor feels I can go back to work if even on a part time basis to start with eventually, will I be entitled to any kind of settlement and and if I am is there any kind of guideline I can use to approximate how much? Would like advice from anyone who has a good answer.
